
Who pays real estate agent commission fees in Spain? Seller or Buyer?
This is one of the most basic questions that customers want to know when buying property in Spain.
First of all, it should be noted that in Spain real estate brokerage is not regulated. In other words, anyone can freely open a real estate agency without any special requirements.
Therefore, only work with serious, professional, accredited companies registered in the official school of real estate agents (API).

So who pays real estate agent commission fees ?
In Spain, the commission is almost always paid by the Seller. The buyer does not have to pay a commission to the real estate agency.
According to a study conducted by Witei, which analyzed 1,000 agencies in Spain, the conclusion is that 82.5% of real estate agencies charge a commission on the Seller and only 12.5% on both sides (Buyer and Seller).
While this is true, there are always exceptions. There may be times when the Seller does not want to pay for brokerage services of a real estate agency, but if the property you have chosen is ideal and you do not want to lose it, an agreement may be reached whereby the Buyer pays for the services of a real estate agency.
